Pani/Pana dane osobowe będą przetwarzane w celu przygotowania i przeprowadzenia procesu rekrutacji oraz archiwizacji koniecznych dokumentów. Podstawą do przetwarzania Pani/Pana danych osobowych są: a)

w przypadku zatrudnienia na umowę o pracę:

art. 6 ust. 1 lit. c RODO oraz art. 9 ust. 2 lit. b RODO (przetwarzanie jest niezbędne do wypełnienia obowiązku prawnego ciążącego na Administratorze) w związku z przepisami cywilnymi, podatkowymi oraz prawa pracy, w szczególności ustawą z dnia 26 czerwca 1974 r. Kodeks pracy (Dział II Stosunek pracy Rozdział I art. 22-24). Pani/Pana dane osobowe są również przetwarzane na podstawie art. 6 ust. 1 lit. a RODO oraz art. 9 ust. 2 lit. a RODO (osoba, której dane dotyczą wyraziła zgodę na przetwarzanie swoich danych osobowych w jednym lub większej liczbie określonych celów), art. 6 ust. 1 lit. b RODO (niezbędność do wykonania umowy lub do podjęcia działań na Pani/Pana żądanie przed zawarciem umowy); b)

w przypadku zatrudnienia na umowę zlecenie:

art. 6 ust. 1 lit. b RODO - przetwarzanie jest niezbędne do wykonania umowy, której stroną jest osoba, której dane dotyczą oraz art. 6 ust. 1 lit. c RODO - przetwarzanie danych wynika z obowiązku ustawowego Administratora w związku z przepisami prawa podatkowego i cywilnego oraz przetwarzane na podstawie art. 6 ust. 1 lit. a RODO oraz art. 9 ust. 2 lit. a RODO (osoba, której dane dotyczą wyraziła zgodę na przetwarzanie swoich danych osobowych w jednym lub większej liczbie określonych celów). c)

w przypadku wyrażenia przez Panią/Pana zgody na przetwarzanie danych w przyszłych rekrutacjach:

art. 6 ust. 1 lit. a RODO oraz art. 9 ust. 2 lit. a RODO (osoba, której dane dotyczą wyraziła zgodę na przetwarzanie swoich danych osobowych w jednym lub większej liczbie określonych celów).

Podanie przez Panią/Pana danych osobowych jest wymogiem koniecznym do realizacji procesu rekrutacji oraz obowiązków narzuconych Administratorowi przez przepisy prawa. Dostęp do danych będą miały osoby pracujące i współpracujące z Administratorem w zakresie realizacji działalności Administratora, w tym prowadzenia strony internetowej, tj. SL Media Sp. z o.o., ul. Józefińska 4/4, 30-529 Kraków, portali służących do publikacji ogłoszeń rekrutacyjnych oraz podmioty realizujące usługi prawno-finansowe oraz informatyczne na rzecz Administratora – każdorazowo będą zawierane wówczas umowy powierzenia. Pani/Pana dane w przypadkach ściśle określonych przepisami prawa mogą zostać ujawnione poprzez przesłanie uprawnionym podmiotom. Pani/Pana dane nie będą przetwarzane w sposób zautomatyzowany, w tym również profilowane, jak również nie będę przesyłane poza Europejski Obszar Gospodarczy. Pani/Pana dane osobowe będą przechowywane a)

w przypadku zatrudnienia na umowę o pracę:

w przypadku pozytywnego zakończenia procesu rekrutacji – przez okres trwania stosunku pracy oraz w obowiązkowym – zgodnym z przepisami prawa – okresie przechowywania dokumentacji związanej ze stosunkiem pracy i akt osobowych – 10 lat, w przypadku negatywnego wyniku rekrutacji – dane osobowe będą przechowywane zgodnie z przepisami prawa, w szczególności uwzględniającymi Pani/Pana prawo do odwołania się od wyniku rekrutacji. b)

w przypadku zatrudnienia na umowę zlecenie:

w przypadku pozytywnego zakończenia procesu rekrutacji – dane osobowe będą przechowywane przez okres trwania umowy oraz po zakończeniu trwania takiej umowy w celu pełnego rozliczenia się stron z warunków umowy, w tym do czasu upływu terminu przedawnienia się roszczeń z takiej umowy (w zależności od rodzaju umowy – zgodnie z ustawą z dnia 23 kwietnia 1964 r. - Kodeks cywilny), a w zakresie rozliczeń z urzędem skarbowym przez okres przedawnienia zobowiązań podatkowych, tj. 5 lat od końca roku podatkowego, w którym pojawiła się konieczność zapłaty podatku. W przypadku negatywnego wyniku rekrutacji – dane osobowe będą przechowywane zgodnie z przepisami prawa, w szczególności uwzględniającymi Pani/Pana prawo do odwołania się od wyniku rekrutacji. c)

w przypadku wyrażenia przez Panią/Pana zgody na przetwarzanie danych w przyszłych rekrutacjach:

dane będą przetwarzane do momentu wycofania zgody, lub nie dłużej niż dwa lata, po tym czasie zostaną trwale zniszczone.

Każda osoba, której dane dotyczą, może zwrócić się z żądaniem dostępu do treści swoich danych osobowych, sprostowania (poprawiania) swoich danych osobowych, usunięcia lub ograniczenia przetwarzania, a w przypadku wyrażenia zgody na przetwarzanie danych do jej wycofania, wycofanie zgody nie ma wpływu na przetwarzanie danych do momentu jej wycofania. W celu realizacji wymienionych praw należy złożyć pisemny wniosek z wybranym żądaniem.
